Los Angeles Restraining Order Lawyer
Being served with a restraining order in Los Angeles starts a clock you did not set. A Los Angeles restraining order lawyer at Power Trial Lawyers can step in on either side of that case, in any of the county’s restraining order courtrooms, from Van Nuys to Long Beach to Stanley Mosk downtown. Restraining orders are the whole practice here, not a side offering.
If you were served this week, the hearing that decides whether the order stays in place for up to five years is roughly 21 days out. Call +1 (888) 808-2179 for a free consultation.
Which Los Angeles courthouse will hear your restraining order case?

It depends on what kind of order was filed, and the answer changes how your case runs. Los Angeles County spreads restraining order work across more courthouses than any other county in California, and the department you land in shapes the calendar, the continuance practice, and how much time a judge gives each side.
Domestic violence restraining orders are family law matters. They are heard in the regional family law courthouses tied to where the parties live. Civil harassment restraining orders under Code of Civil Procedure section 527.6 are civil matters, and downtown Los Angeles handles a large share of them at the Stanley Mosk Courthouse.
| Order type | Where it is usually heard in LA County |
|---|---|
| Domestic violence restraining order (DVRO) | Regional family law courthouses: Van Nuys, Long Beach (Governor George Deukmejian), Pasadena, Santa Monica, Torrance, Norwalk, Pomona, Compton, Inglewood, Chatsworth, Burbank, Lancaster |
| Civil harassment restraining order (CHRO) | Stanley Mosk Courthouse, downtown Los Angeles, and select regional civil departments |
| Workplace violence restraining order (WVRO) | Civil departments, filed by the employer rather than the employee |
| Elder abuse restraining order (EARO) | Civil departments, with some probate overlap |
| Criminal protective order (CPO) | The criminal courthouse handling the underlying case, including the Metropolitan and Clara Shortridge Foltz courthouses |
Filing in the wrong division costs weeks. So does assuming a downtown filing when the parties both live in the San Fernando Valley. You can confirm a courthouse assignment through the California Courts find my court directory, but the routing question worth asking is not only where the paperwork goes. It is which department, which calendar, and how that department handles contested hearings.

How much time do you actually have before the hearing?
Twenty-one days from the date the temporary order was granted or denied, or 25 days if the judge finds good cause to extend. That deadline is statutory, and it applies to both sides.
For domestic violence orders, the window comes from Family Code section 242. For civil harassment orders, the same 21 or 25 day structure appears in Code of Civil Procedure section 527.6.
Here is what that means in practice. If you were served on a Friday, you may have fourteen usable business days to gather records, locate witnesses, prepare a written response, and get exhibits into a form the court will accept. Phone carriers do not return subpoenaed records in fourteen days. Neither do most employers. The people who lose these hearings are often the people who started preparing in week three.
What happens in the first 72 hours after you are served in Los Angeles
Read the order before you do anything else. The temporary order is already in effect the moment you are served, and the terms are specific. Most people scan it for the hearing date and miss the part that matters.

Look for four things:
The stay-away distance. One hundred yards is common. If the protected person lives near you, works near you, or attends the same school, that distance may make your normal routine a violation.
The no-contact language. Many orders bar all contact, including text, email, social media, and messages passed through friends or family. Responding to a message the protected person sent you can still be a violation.
The move-out order. Some orders require you to leave a shared residence immediately, whether or not your name is on the lease.
The firearm terms. Under Family Code section 6389, a restrained person cannot own, possess, purchase, or receive a firearm or ammunition while the order is in effect. Surrender is due within 24 hours of service, and the receipt has to be filed with the court and the serving agency within 48 hours. The California Courts self-help page on firearms orders walks through the mechanics. Missing that deadline is itself a violation of the order.
Then stop communicating. Not because it looks bad, though it does. Because a violation of the temporary order can become a separate criminal charge under Penal Code section 273.6, and a pending violation charge changes the shape of the restraining order hearing entirely.
Why do so many Los Angeles restraining order cases turn on scheduling?
Because the county’s volume creates pressure that smaller counties do not have. Los Angeles courtrooms handle heavy restraining order calendars, and a contested hearing that needs live testimony from three witnesses does not always fit the morning calendar it was set on.
That produces two outcomes worth planning for. Cases get trailed to the afternoon or continued to a later date, and the temporary order usually stays in place while that happens. Or the court moves quickly, and a party who showed up expecting to tell their story finds out they have twenty minutes.
Either version rewards the side that walked in with exhibits already organized, witnesses already present, and a written response already on file. Neither rewards improvisation.
Do you need a lawyer for a restraining order hearing in Los Angeles?
You are not required to have one, and many people appear on their own. Whether you should depends on what the order would cost you and how contested the facts are.

The hearing is an evidentiary proceeding with rules of evidence, a burden of proof, and a right to cross-examine. Most people who represent themselves have never cross-examined anyone. They tend to argue with the other party instead of building a record, and the record is what an appellate court would eventually review.
There are situations where the stakes make counsel close to necessary:
- You hold a professional license, a security clearance, or a job that runs background checks
- The order would remove you from your home
- Custody or a pending divorce is running alongside the restraining order case
- You are not a United States citizen
- A criminal case is open on the same facts
- The petition contains allegations you believe are fabricated or materially exaggerated
For a deeper look at how the hearing itself runs, including what evidence gets in and what the petitioner has to prove, see our page on the California restraining order hearing.

What does a restraining order cost you beyond the courtroom?
More than most people expect, and the consequences outlast the hearing. An order after hearing can run up to five years under Family Code section 6345 for domestic violence matters, and it can be renewed.
The order also enters the California Restraining and Protective Order System, which means law enforcement sees it on any contact. Firearm rights are suspended for the life of the order. Employers that run background checks may see it. Family courts weigh domestic violence finding heavily in custody decisions. For non-citizens, an order and any related conviction can carry immigration consequences that a family court judge is not required to explain.
None of that is an argument for panic. It is an argument for treating the hearing as the one opportunity to keep the finding from being entered at all.
How Power Trial Lawyers handles Los Angeles restraining order cases
We build the hearing backward from the record the court will actually have in front of it.
Attacking the petition on its own terms. A petition is a sworn declaration. Sworn declarations contain dates, times, and places, and those details can be measured against phone records, location data, work schedules, and messages. Where the declaration and the documentary record disagree, that gap is the case.
Cross-examination built for credibility, not conflict. Cross-examination at a restraining order hearing is not an argument. It is a short series of questions the witness has to answer, aimed at the specific points where their account cannot hold.
Procedural defenses. Defective service, a petition filed under the wrong statute, allegations that fall outside the statutory definition of the conduct being restrained. These are not technicalities when the statute is what gives the court authority to act.
Fee recovery where the statute allows it. In civil harassment cases, section 527.6 lets the court award costs and attorney’s fees to the prevailing party, which includes a respondent who defeats a petition. We ask for it when the facts support it.
Matthew Barhoma leads the firm’s restraining order work and has appeared as a legal analyst on CNN, Fox News, Law & Crime, and in the Los Angeles Times, breaking down trial strategy, cross-examination, and evidentiary rulings. That is the same analysis applied to a contested hearing on a 21 day clock.

If you are the one seeking protection in Los Angeles
This section is for petitioners. Everything above addresses the person who was served.
Filing is free, and you do not need a lawyer to file. The California Courts self-help guide on civil harassment restraining orders covers the forms and the process, and the family law clerk’s office can direct you to the domestic violence forms.
Where counsel makes a difference is the hearing, not the filing. Petitions get denied for reasons that have nothing to do with whether the conduct happened. Common ones:
- The declaration describes how the petitioner felt rather than what the respondent did, on which dates
- The evidence is a folder of screenshots with no dates, no context, and no way to authenticate them
- The petition was filed under the wrong statute for the relationship between the parties
- The request asks for relief the statute does not allow, which invites the court to deny the whole thing
- The petitioner is unprepared for cross-examination and contradicts their own declaration on the stand
If you filed and the hearing is coming, or the respondent has retained counsel, call +1 (888) 808-2179. We represent petitioners in Los Angeles and throughout Southern California.

The temporary order is in effect now. The hearing is roughly three weeks out. What happens in that room is decided by the preparation that happens before it, and that preparation gets harder every day you wait.
